Abstract

The objective of this article is to analyze the deficiencies in the provision of medical care due to the non-compliance and/or transgression of the norms and laws that govern the medical-clinical practice by institutional physicians and residents, and to review these norms using as a paradigm the study and opinion of a case related to the illegal preparation of an informed consent, This procedure was carried out by residents without the supervision of the attending physicians and without clinical or laboratory support in the clinical record, an act that complicated the patient's state of health and caused his death. Likewise, the irregularities incurred by a doctor, accredited as an expert by a governmental institution that carried out the study of the case, in issuing a partial and defective opinion, were analyzed. It should be remembered that all medical procedures must be performed based on the scientific, ethical and legal principles that govern medicine. Likewise, with the exposition of transgressions to the medical-legal regulations, it is intended to contribute to avoid that institutional physicians and/or residents incur in acts or omissions that may cause alterations in the health and/or life of patients and that the opinions of physicians accredited as experts, incorrectly influence in the administration of justice.
